DISCLAIMER

I. Right to Restrict Entry and Evict Participants

Operation: Event Management, acting on behalf of the Black Hills Rod Run (hereinafter referred to as "the Event"), explicitly reserves the right, at its sole discretion, to:

• Restrict Entry: Deny admission to any individual or vehicle to any and all activities associated with the Event.

• Evict Participants: Remove any entrant, their vehicle, or associated individuals from the Event premises.

Grounds for restriction or eviction include, but are not limited to:

• Unacceptable Behavior On-Site: Any conduct during Event activities deemed objectionable by Event Management, including but not limited to:

  • Operation of vehicles with open headers.

  • Unnecessary tire spin or any exhibition of reckless driving.

  • Any other behavior, appearance, or conduct of the entrant, their vehicle, or associated individuals that Event Management deems inappropriate or disruptive.

• Unacceptable Behavior Off-Site: Any poor behavior exhibited off the Event grounds by an entrant or associated individuals may constitute grounds for denying admittance of the entrant and their vehicle to the Event premises.

• Objectionable Items: The presence or distribution of any person, thing, conduct, print matter, or any other act deemed objectionable by Event Management.

II. No Liability for Refund

The Counts of the Cobblestone Car Club, Inc. (hereinafter referred to as "the Organizer") shall not be liable for refunding any entry fees in the event of restriction of entry or eviction of a participant.

III. Release and Discharge of Liability

In consideration for the acceptance of the right to participate in the Black Hills Rod Run or any other Counts of the Cobblestone, Inc. activity, each entrant and spectator, by execution of the entry form, hereby fully releases and discharges the Organizer, the State of South Dakota, the City of Black Hawk, and their respective officers, directors, employees, agents, representatives, and servants, as well as any other individuals or entities connected with the management and presentation of the Event or other Organizer activities, from any and all known or unknown damages, injuries, losses, judgments, and causes of action for bodily injury or death, and from any and all liability occasioned or resulting from the conduct of the entrant or any participants assisting or cooperating with the entrant and under the direction or control of the entrant. This release extends to any liability arising from or related to the entrant's participation in the Event or any associated activities.
